Information for Texas Clients

I believe clients should have clear access to information about their care, including how to access records, understand their rights, and reach the appropriate regulatory agencies when needed.

Below you’ll find information about: requesting your records, contacting the applicable licensing authority, and filing a complaint or concern.

This information is provided in accordance with Texas House Bill 4224 and Texas Health & Safety Code §181.105.

  • You have the right to access and receive copies of your health care records. To ensure the security of your Protected Health Information (PHI), NeurodivUrgent requires that all record requests be submitted through our secure HIPAA-compliant portal.  

    • Instructions: Log in to your client portal. Navigate to the messaging section, and message me to let me know that you would like a copy of your records.

    • Timeline: In accordance with Texas law, we will respond to your request within 15 business days.

    • Fees: We may charge a reasonable, cost-based fee for the retrieval and copying of records as permitted by Texas Law.

  • Dr. Duncan is a licensed psychologist in the state of Colorado (Colorado Licensed Psychologist #5665) practicing telepsychology in Texas under PSYPACT telepsychology authority (APIT # APIT #14302). You can verify their license here.

  • With the Provider:
    If you are dissatisfied with your experience, you are encouraged to discuss your reactions directly with your provider. Understanding your reactions and experiences gives us an opportunity to make things right and can help us adjust our approach in order to prevent future clients from having similar experiences. You can message your complaint to us directly through the client portal, or, if you prefer, we can set up a time to meet via phone or video conference.

    With the Executive Council:
    The Texas Behavioral Health Executive Council investigates and prosecutes professional misconduct committed by marriage and family therapists, professional counselors, psychologists, psychological associates, social workers, and licensed specialists in school psychology. If you would like to report suspected professional misconduct, you can contact the Texas Behavioral Health Executive Council by phone at 1-800-821-3205.

    With the Attorney General:
    The Attorney General of Texas collects and maintains records of consumer complaints to protect Texas residents from unlawful business practices. Information on how to submit a consumer compliant may be found here on the Attorney General's website.

    Know that under Texas law, consumer complaints are open to the public, and the Attorney General's office asks that you do not include sensitive or confidential information in your complaint.
